Mandatory Wealth Declaration and Public Disclosure for High-Earning Government Employees

Preamble
In recognition of the fundamental principle that public office is a position of trust, and in acknowledgment of the need for uncompromising transparency in the service of the Dominican people,
Considering that the concealment of personal wealth and the manipulation of financial records by public officials erodes citizen confidence, fuels corruption, and obstructs the fair administration of government,
In pursuit of a future where the Dominican Republic stands as a model for integrity and open governance in the Caribbean and Latin America,
By the powers vested in the Office of the President under the Constitution of the Dominican Republic, it is hereby decreed:

Article 1 – Annual Wealth Declaration Requirement
All government employees, regardless of position, whose annual salary, compensation, or total official earnings amount to RD$5,000,000 (five million Dominican pesos) or more, shall be obligated to submit a verified and sworn declaration of personal net worth.

Article 2 – Submission of Historical Tax Records
Such individuals shall also be required to submit complete and certified copies of their personal tax returns for the previous five (5) fiscal years. These records must be free from alteration and accompanied by an affidavit affirming their accuracy.

Article 3 – Public Accessibility Through a Transparency Database
The Government Transparency Database, a newly created and securely managed digital registry, shall publish the names, positions, declared net worth, and annual income of all government employees meeting the RD$5,000,000 threshold.
This database shall be freely accessible to the public without restriction and updated annually to reflect the most current declarations and records.

Article 4 – Independent Verification
The National Office of Public Integrity shall independently audit submitted declarations and tax records. Any discrepancy, omission, or evidence of asset concealment shall be grounds for immediate investigation and disciplinary action.

Article 5 – Penalties for Non-Compliance and Fraud
Any government employee found guilty of:
(a) Concealing assets,
(b) Falsifying wealth declarations, or
(c) Refusing to submit required documentation,
shall be subject to a monetary fine of RD$10,000,000 (ten million Dominican pesos) and may be sentenced to a term of imprisonment of up to fifteen (15) years.
Such imprisonment shall be served without eligibility for bail, parole, or early release.

Article 6 – Scope of Application
This decree applies to all government branches, ministries, agencies, commissions, and state-owned enterprises, including but not limited to elected officials, appointed executives, and career civil servants.

Article 7 – Effective Date
This decree shall take immediate effect upon the commencement of the new presidential term and shall remain in force until repealed or replaced by subsequent legislation.
